Ex Chief Inspector Peter Newman was at Moranbah North on the 15th March. Why is there No Mine Record Entry by CIOCM Peter Newman?

Part of  my RTI for Moranbah North was for  Mine record entries made by RSHQ relating to the “overpressure” event at the Moranbah North Coal Mine on or around 20 February 2021.

There is one Mine Record Entry that has not been provided under my RTI.

It is the one ex Chief Inspector Peter Newman is directly obligated to write after Inspecting Moranbah North Mine on the 15th of March 2021

Inspector Brown attended Moranbah North Mine site for the purpose of collecting samples from borehole collars and or gas drainage infrastructure, pursuant to s143 Seizing evidence at coal mine or other place.

During this after a question from ANGLO Management, Inspector Brown notes how he discussed the Issue with the then Chief Inspector of Coal Mines Peter Newman, who just happened to be on the Moranbah North Mine site conducting his own Inspection that day, and was no doubt engaged in formal meetings and conferences

Mr XXXX asked if RSHQ will be sharing the analysis results of samples taken today, I undertook to make this request to the Chief Inspector whom has since being at the site has approved sharing of these results

Well where is the Mine Record Entry that the CIOCM Newman is directly obligated to write under CMSHA 1999 Section 173     

Records must be kept

 (1)          An inspector, inspection officer or industry safety and health representative must keep an accurate record of all reports and directives given by the inspector, officer or representative under this Act.

(2)          An inspector, inspection officer, authorised officer or industry safety and health representative must make a written report of every inspection of a coal mine made by the inspector, officer or representative under this Act.

Well where is it.

Remember this is the first day of the second week of the second tranche of Grosvenor Board of Inquiry.

RSHQ paid consulting Investigators Marty Denham – Electrical Fire Investigator, Rob Thomas – Principal Geotechnical Engineer are giving evidence on the 15th of March and Martin Watkinson from SIMTARS (17th) and Sean Muller from SIMTARS (18th) are also due to give sworn testimony.

At least Mr. Watkinson and I assume Mr. Muller, have also been at Moranbah North for some weeks before giving evidence at the Grosvenor Inquiry. Both also conveniently forgot to mention to the Inquiry, they had been at Grosvenor’s sister pit Moranbah North dealing with exactly the same sort of event that occurred at Grosvenor.

Either

  1. Ex Chief Inspector Newman never wrote a Mine Record Entry and is in direct breach of his obligations for reasons known only to Peter Newman.
  2. RSHQ accidentally neglected to include it in response to my RTI

I am going to assume that RSHQ when responding to my RTI could not locate any relevant Mine Record Entry from the Chief Inspector Newman.

What possible reason would then Chief Inspector Newman have in not filling out a Mine Record Entry and being in clear breach of his obligations?

Why would he not record the discussions he had with Senior Anglo Management on site at the Moranbah North Coal Mine that day?

Why would ex Chief Inspector not raise any of the facts as RSHQ Investigating Inspectors and himself know about the spontaneous combustion event at Moranbah North at the Grosvenor Inquiry?

Did you even talk to any of the Production and Engineering workers while you were on site Peter Newman?

Did it never cross your mind that as the then Chief Inspector you have a few big sticks under the Coal Mining Act, some at your unique disposal as CIOCM to address unacceptable levels of risk to workers?

Powers not available to ordinary Inspectors of Coal Mines or even the Deputy Chief Inspector of Coal Mines, Mr. Shaun Dobson.

Couldn’t you even be bothered to write a Mine Record Entry to let the Coal Face Cannon Fodder know you actually flew from Brisbane and had a meeting with only the Most Senior Anglo Management and lovely cups of tea and cucumber sandwiches cut into these cute little triangle’s?
